Foxtel Privacy Statement

We appreciate that your privacy is important to you. Foxtel has compiled this page to advise you how your personal information is handled including how we collect, hold, use and disclose that information through any interaction you have with Foxtel.

Foxtel is committed to protecting your personal information and we comply with the National Privacy Principles (NPPs) set out in the Privacy Act 1988. The NPPs regulate the way that organisations can collect, use, keep, secure and disclose personal information. It also gives individuals the right to know what information an organisation holds about them and a right to correct that information if it is wrong.

This Privacy Statement should be read in conjunction with your Residential Digital Subscription Agreement and capitalised words used here are defined in that document.

We may collect personal information

When you apply for and use the Foxtel Service we collect personal information about you which we require in order to set up your account (your personal information) such as your name, contact details and credit card or bank account information.

Foxtel may also collect personal information about you from a third party, such as from a list rental company for the purpose of telemarketing and direct marketing. If you are not a Foxtel subscriber and you do not want to receive telemarketing calls you can get further information at www.donotcall.gov.au. If you are not a Foxtel subscriber and you do not wish to receive direct marketing then please call us on 131 999.

Collection specific to using this website

Foxtel also collects information regarding activity on its website, such as the number of visitors to the website, the date and time of those visits, the number of pages viewed and navigation patterns. This information does not personally identify you. It is obtained using ‘cookies’ which are frequently used by websites to identify users’ computers. This information on its own does not identify an individual but it provides Foxtel with statistics that we can use to analyse and improve our website and the Foxtel Service. This information is collected on Foxtel’s behalf by Google Analytics, located at www.google.com/analytics/, Netratings Australia Pty Ltd, located at www.nielsen-netratings.com.au, Adobe Systems Software Ireland Limited at www.adobe.com, and Microsoft Corporation at www.microsoft.com.

How we use your information

Foxtel may use your information for purposes which you would reasonably expect, such as managing your account, billing, contacting you about the Foxtel Service (including about your Equipment) and providing customer support. In addition, we may use your personal information:

  • to assess your application for the Foxtel Service;
  • to provide and administer the provision of the Foxtel Service, including billing you and investigating or resolving any disputes relating to the Foxtel Service provided to you;
  • for planning, research, product development customisation, and strategic, financial and other business purposes in relation to our products and services; and
  • for promotional and marketing purposes.

If you do not wish for us to use your personal information for marketing purposes, you may request at any time to opt out of receiving such communications by contacting us on 131 999 or writing to us at enquiries@foxtel.com.au.

How we disclose your information

We will disclose your personal information where you would reasonably expect us to do so, when you have consented or where the disclosure is for an activity related to the purposes for which your information was collected. Foxtel may provide your information to organisations (which are defined as Suppliers, Contractors, Interactive Advertisers, Related Companies and Authorised Providers) associated with the provision of the Foxtel Service - for example, this may include channel providers or mercantile agents who help us to collect overdue payments. These organisations use and disclose your personal information in accordance with their privacy policies. If you want to know more about who these organisations are, and what their approach to privacy is, or if you wish to access any personal information held about you by them please contact us.

There may also be some exceptional circumstances for disclosing your information where required by law, or to government and enforcement agencies or individuals appointed by a government (including the Telecommunications Industry Ombudsman, Australian Communications Association and Australian Communications Industry Forum) responsible for investigating and resolving disputes or complaints concerning your use of the Foxtel Service to enable the investigation and resolution of a dispute or complaint.

In addition, we may disclose your personal information to our Business Partners who will use and disclose it for the purpose of planning, research, product development and strategic, financial and other business purposes in relation to their products and services. Our Business Partners use and disclose your personal information in accordance with their privacy policies. Security and quality of your information

We take all reasonable steps to ensure that the personal information we collect, use or disclose is accurate, complete, up-to-date and stored securely.

Access

We will provide you with access to your personal information that we have about you, but sometimes that will not be possible, in which case we will tell you why. If you want to find out what information we have about you contact us on 131 999. We will ask you to put your request for access in writing and provide proof of your identity. You may be charged an administration fee when we provide you with the requested information to cover our time and postage and handling costs.

If you think that any personal information we hold about you is not accurate, complete and up-to-date, you may ask us to correct that information. We will take reasonable steps to correct such personal information unless we disagree with you about whether the information is accurate, complete and up-to-date.

Viewing Habits Data

In addition to personal information, we may also collect Viewing Habits Data when you use (or someone at your address or related to your Account uses) the Foxtel Box and some Ancillary Services.

We may disclose your viewing habits data to third parties including Interactive Advertisers or our channel suppliers but this will not include information that identifies you personally to them.

Credit reporting

The Privacy Act allows us to give a credit reporting agency certain personal information about you. The information we disclose to a credit reporting agency includes:

  • permitted information which will allow you to be identified;
  • the fact that you have applied for credit and the amount;
  • the fact that we are a current credit provider to you;
  • payments that are more than 60 days overdue and for which debt collection action has started;
  • information that in our opinion you have committed a serious credit infringement (that is, acted fraudulently or shown an intention not to comply with your credit obligations); and
  • cheques drawn by you for $100 or more which have been dishonoured more than once.

If we report your default to a credit reporting agency your credit rating may be affected and you may have difficulty obtaining credit in the future.
