The AUSTAR Guide Android app (the "Application") is owned and operated by AUSTAR Entertainment Pty Limited (ACN 068 104 530). Your use of the Application is subject to these Terms and Conditions and, where relevant, AUSTAR's Customer Agreement. This Application is optimised for use on Android supported devices. To access the Application, you must have a current account with a mobile provider that includes internet access or access to a wireless internet service. This Application may also be used on tablet devices, supported by the Android Operating System, although the Application is not optimised for this use.
If you subscribe to the AUSTAR subscription television service, your login details will be the same as those you use to access the My Account service on AUSTAR's website. If you subscribe to the AUSTAR subscription television service and have not registered with My Account, you need to do this before you can use the Application.
The Application is provided to you at no cost, however you will be responsible for any costs incurred with your mobile operator and/or your ISP downloading, installing and using the Application, including downloading any information that populates the Application. You are also responsible for any downloading charges that are incurred by anyone else using the device on which you have installed the Application.
When you, or anyone using your device, access the Application, AUSTAR may collect information regarding the use of the Application including: number of users, number of pages viewed, number of remote recordings and the average session duration. You agree that AUSTAR may use this information to analyse and improve the Application. You also agree that the information may be collected on AUSTAR's behalf by a third party, but that the third party will not be entitled to use this information for any purpose other than to on-provide this information to AUSTAR. The collected information will not include any personal information that will identify the users name, address or financial details.
AUSTAR does not make any guarantees and does not provide any undertaking that the Application will be available at all times or that it will be error free, secure or that any defects will be corrected. You agree that you use the Application at your own risk and that AUSTAR disclaims any and all responsibility for any damage or loss that you may suffer or incur as a result of using the Application, whether they are direct or consequential (including loss of profits, loss of business revenue or loss of goodwill). This includes any loss that results from any interference, malfunction or damage that occurs to your Android supported devices, arising from installing, updating or using the Application.
AUSTAR may change these Terms and Conditions at any time in its sole discretion. These Terms and Conditions are governed by the laws of New South Wales and you agree to irrevocably submit to the non-exclusive jurisdiction of the court of New South Wales.
Trademarks contained in the Application are owned by or licensed to AUSTAR Entertainment Pty Limited and may not be used without AUSTAR's express written consent.
